Terms of Service

These terms govern your use of 28digitalstudio.com and purchases or services provided by 28 Digital Studio. A signed proposal, statement of work, order form, or other written agreement controls if it conflicts with these website terms.
Using this site
You may use this site for lawful business purposes. You may not try to disrupt the site, bypass security, misuse forms, scrape protected areas, introduce harmful code, or use studio content in a way that infringes another person's rights.
Services and scope
Public pages describe standard offers, starting prices, typical timelines, and included work. Final scope, schedule, assumptions, deliverables, revision limits, dependencies, and acceptance criteria are confirmed in the applicable checkout description or written agreement. Work outside that scope may require a separate quote or change order.
Your responsibilities
You are responsible for providing accurate information, lawful content, timely feedback, and the accounts or access reasonably needed to perform the work. You confirm that you have the right to use materials you supply. Delays in content, access, approvals, or third-party decisions may move a delivery date.
Pricing, payment, and taxes
Prices are in U.S. dollars unless stated otherwise. Stripe processes website payments and may offer payment methods or financing subject to its own eligibility rules and terms. You are responsible for applicable taxes unless a written agreement says they are included. Work begins only after the stated payment and intake requirements are complete.
30-day website satisfaction guarantee
If a Launch Site, Growth Site, or Authority Site checkout expressly includes the 30-day satisfaction guarantee, you may request a refund of the 28 Digital Studio website-package fee within 30 calendar days after final website delivery. Email jonahs@28digitalstudio.com from the purchase email and identify the order.
The guarantee does not refund domain registrations, third-party software or licenses, payment-processing charges that cannot be recovered, ad spend, or separately approved out-of-scope work. After a full refund, you must stop using unreleased custom work and return or remove transferred access and files where reasonably possible. Refund timing after approval is controlled by Stripe and your financial institution. A written project agreement may state different terms and will control for that project.
Cancellations and other refunds
Except for the guarantee above or a different written refund term, amounts paid are non-refundable once work has started because studio time and capacity are reserved for the project. Subscription offers may be canceled for future billing according to their checkout or written agreement; prior charges remain due.
Ownership and portfolio use
Ownership and licensing are defined in the project agreement. Unless it says otherwise, after full payment you may use the final custom deliverables for your business. 28 Digital Studio retains ownership of pre-existing tools, reusable components, methods, templates, and know-how. The studio may identify you as a client and display public-facing work in its portfolio unless you and the studio agree otherwise in writing.
Third-party services
Hosting, domains, payment processing, scheduling, analytics, email, content systems, advertising platforms, and other integrations are operated by third parties. Their availability, pricing, policies, review decisions, and data practices are outside the studio's control. You may need to accept their terms and maintain your own accounts.
Results and AI-assisted work
We do not guarantee revenue, leads, search rankings, advertising results, platform approval, or any other business outcome. Strategy, forecasts, and estimates are professional judgments, not promises. AI-assisted material may require human review; you remain responsible for approving claims, decisions, and final business use.
Disclaimers and liability
The public site is provided on an as-available basis. To the fullest extent permitted by law, 28 Digital Studio is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from the site or services. Any aggregate liability for a paid service is limited to the amount you paid the studio for the service giving rise to the claim. Some jurisdictions do not allow every limitation, so these limits apply only where lawful.
Governing law and changes
Florida law governs these terms without regard to conflict-of-law rules, and disputes will be brought in courts located in Miami-Dade County, Florida, unless a written agreement or applicable law requires otherwise. We may update these terms as offers or legal requirements change. The effective date above identifies the latest version.
